1. Introduction

Welcome to Mixabl. This Privacy Policy explains how Completion, Rakotondrainibe ("Controller", "we", "us") collects, stores, and processes data when you use the Mixabl software application ("Software") and visit our website (mixabl.ai). We respect your privacy and are committed to complying with the Swiss Federal Act on Data Protection (FADP) and, where applicable, the General Data Protection Regulation (GDPR).

Since Mixabl is an offline-first professional audio software, our application data collection is strictly minimized to what is necessary for licensing, anti-piracy operations (telemetry), and software quality improvement (crash reporting).

3. Data We Collect

When you activate and use the Software, we collect limited technical and licensing data:

Important: We do NOT collect, listen to, store, or process your local audio files, stems, or musical metadata on our servers. Mixabl processes all audio locally on your machine.

4. Purpose and Legal Basis of Processing

We use this data exclusively for:

Legal Basis: We process personal data where necessary for the performance of our license agreement with you, for compliance with legal obligations where applicable, and for our legitimate interests in preventing fraud, enforcing licensing restrictions, maintaining service security, and protecting our intellectual property.

Providing certain technical licensing data is necessary to activate, validate, and maintain your license. If you do not provide or permit the processing of such data, the Software may not activate or continue to function properly.

Your application data (as described in Section 3) is not used for marketing, tracking, behavioral analysis, or advertising. For information about optional website cookies, see Section 7.

5. Storage, Security, and Recipients

Your data is securely processed and stored on servers provided by Infomaniak, located entirely within Switzerland. Switzerland is recognized by the European Commission as providing an adequate level of data protection for relevant data transfers from the EU.

Recipients: Recipients of personal data may include our hosting and infrastructure providers, security providers strictly necessary to operate the licensing service, payment processors for transaction-related data, and Functional Software, Inc. ("Sentry") for crash and error monitoring services with data stored in the EU (Frankfurt, Germany).

6. Data Retention

Licensing records are retained for the duration of the active license and for a limited period thereafter as necessary to handle renewals, disputes, fraud prevention, accounting, and legal obligations. Diagnostic and telemetry logs are retained only for a short period and deleted on a rolling basis unless needed for a specific security or support incident.

7. Third-Party Services & Website Cookies

We may use third-party payment processors (e.g., Stripe) to handle your purchase of the Software. These processors collect your payment and billing information independently. Please review their respective Privacy Policies, as we do not directly process or store your credit card information.

We use Sentry (Functional Software, Inc.) for crash and error monitoring. When a crash or error occurs, anonymized diagnostic data is transmitted to Sentry's EU-based servers (Frankfurt, Germany). Sentry processes this data as a data processor under our instructions. No audio content, file content, or personal file paths are transmitted. For more information, see Sentry's Privacy Policy.

Website Cookies and Analytics: On our website (mixabl.ai), we use optional cookies and scripts from Google Analytics, Google Ads, and Meta Pixel to measure site traffic, understand visitor behavior, and evaluate marketing performance. These tools are blocked by default and only execute if you grant explicit consent through our cookie consent banner. You can update your choices at any time via the Cookie Settings trigger on the website.

8. Your Rights

Under the Swiss FADP and, where applicable, the GDPR, you may have the right to request access to your personal data, rectification of inaccurate data, deletion, and, where applicable, restriction of processing, objection to certain processing, and data portability. You may also lodge a complaint with a competent data protection supervisory authority.

(Note: If essential licensing data is deleted, the Software may no longer activate or your license may cease to function).
